3. Our Obligations

3.1 We will endeavour to ensure that the Transport Service Provider allocates the Vehicle requested in the Booking to complete your Journey although we are unable to guarantee the make and model. When this is not possible we will use our reasonable endeavours to obtain a replacement Vehicle which is of the same standard as the Vehicle requested in the Booking. The vehicle images shown in the Website are only illustrative examples. These are not connected with any right to a particular vehicle model for the booked vehicle category – regional differences are especially possible.

3.2 We will provide the Transport Service Provider with details of the Booking.

3.3 Once we have received confirmation from the Transport Service Provider that your Booking can be fulfilled we will send a confirmation email and confirmation text message with your Booking details to the email address and phone number given during the booking process and take payment for the Booking.

3.4 No later than 24 hours prior to your Pick Up Time, we will send an email containing emergency contact details for the Transport Service Provider to the email address given during the booking process.

4. Your Obligations

4.1 Although we strive to ensure the accuracy of the information on this Website, neither we nor our affiliates, suppliers or agents can be held responsible by you, the Booker, for the accuracy of such information. The images displayed on our Website are for illustrative purposes only. It is solely your responsibility to evaluate the accuracy, completeness and usefulness of all information provided on this Website.

4.2 You must ensure that you have provided us with full and accurate details of the requirements for your Booking, including, but not limited to, accurate timings (date and hour, using the local time applying at the Pick Up Location) for the Pick Up Time, Pick Up Location, Drop Off Location and, where applicable, flight number, train times or ferry times.

4.3 You must ensure that you check that your Booking details are complete and accurate.

4.4 You must ensure that the Passengers have reserved sufficient time to reach your/their destination when arranging the Pickup Time, taking into consideration the possibility of delays caused by traffic accidents or congestion, the weather conditions, or local events.

4.5 The need for safety seats for children should be requested by You as an additional comment by specifying the number and age of children to be transported as well as the required type of seating.

4.6 You must ensure that the Passengers are at the Pickup Location at the Pickup Time.

4.7 You must provide us with valid contact information to enable us to contact you if necessary and provide you with information regarding your Booking.

4.8 You must ensure that you and/or the Passengers (as appropriate) have a telephone, with the contact number you have provided, switched on and with you and/or the Passengers (as appropriate) at the Pick Up Time and for the duration of any waiting time as set out at clauses 6.3 and 6.4.

4.9 You must ensure that any Passengers under the age of 18 are accompanied by a responsible adult.

4.10 All Passengers must be fit to travel. Drivers, acting reasonably, reserve the right to refuse the Services to any person who is considered unfit to travel, or who is abusive, intoxicated, underage, or if carriage of any such Passengers and/or luggage would cause the Driver to be in breach of any applicable traffic and/or road safety regulations, or may damage the Vehicle. This also applies to animals which are not contained in a closed and suitable transport box. We will not be liable for the completion of any travel arrangements, nor for any refund, compensation or any other costs whatsoever that You and/or any of the Passengers (as appropriate) may incur in such circumstances.

4.11 You must ensure that You have chosen the appropriate vehicle category for your needs. When choosing your vehicle category, You should consider the number of Passengers travelling in the Vehicle and the amount of luggage space required and check that the Vehicle meets your needs. The Transport Service Provider reserves the right to refuse carriage if compelling (for example under applicable laws) requirements under Paragraph 4 were not at all, or not correctly, communicated by You as an additional comment.

If, due to this, carriage is not possible, this has no influence on the payment of Bucharestairporttransfers.ro through the arrangement agreement with You for the transportation booked.

4.12. The following behavioral standards apply to You and any other passengers when traveling with the TSP:

During the entirety of the ride, all passengers must follow the regulations which apply to the relevant Road Traffic Act, especially the seatbelt regulations. Any instructions given by the TSP must be followed. It is the responsibility of the TSP to ensure a safe ride. It is therefore prohibited for passengers to open the doors while driving, throw any objects from the vehicle, and/or stick body parts out of or shout from the vehicle. If You wish to use any of the devices or facilities in the vehicle, a brief instruction is required from the TSP.

Alcohol or narcotics are prohibited from being consumed in any vehicle, and smoking is forbidden inside the vehicles. The consumption of food is discouraged. If You, or passenger, ignores this, they are liable to pay not only the cost for the cleaning of the vehicle but also compensate the loss of business due to the downtime of the vehicle.

4.13 You are responsible for ensuring that the Passengers comply with all provisions of the Terms where necessary or required to enable You to comply with the Terms, and You shall be liable for all acts and omissions of the Passengers.

4.14 You are solely responsible for carrying the necessary documentation for frontier crossing. Neither we nor the TSP are responsible for any losses caused by your failure to carry these documents or for failure to observe customs, police, tax authorities or administrative rules of those countries where entry is required. The booking is not a valid document to obtain entry visas.

4.15 You agree to indemnify and reimburse us for any deposit, fine or payment that we have to pay the authorities through your failure to observe the laws, regulations, etc. or other travel requirements of those countries which you intend to enter or leave or pass through. In this event, we shall have the right to retain any amounts belonging to you until you have made payment to us in full.

5. Price and Payment

5.1 Principles

5.1.1 The compensation claim of Bucharestairporttransfers.ro is specified in the Booking Confirmation.

5.1.2 Key factors for its amount (including reimbursement of expenses to Bucharestairporttransfers.ro for the arranged transportation service) are: the chosen vehicle class, the distance, how far in advance the ride is booked, as well as the pickup time and possibly the location.

5.1.3 Additionally booked special requests, e.g. multilingual drivers, individual vehicle labeling, additional stops, bulky luggage, car seats for children, etc. may cause the price to increase.

5.1.4 Except where You and/or any Passenger agree to changes to the Journey with the Transport Service Provider and/or the Driver, all tolls, congestion charges, taxes and gratuity charges are included in the price quoted on the Website and shown on the Booking. Any additional tolls, congestion charges, taxes and gratuity charges arising out of changes to the Journey must be paid by You or the Passenger, as appropriate.

5.1.5 You and/or the Passengers may be charged if changes are made to your Journey once the Passengers have been picked up by the Driver. Such additional charge will be agreed locally with the Driver and/or Transport Service Provider and paid to us or the Driver at the Pickup Time (by such means as we or the Driver or the Transport Service Provider shall indicate). The Driver and/or Transport Service Provider reserves the right to decline any unreasonable requests to amend the Journey and neither we nor the Driver nor Transport Service Provider shall have any liability to You if You make changes to the Journey that are not acceptable to the Driver and/or the Transport Service Provider.

5.1.6 We will pre-authorise (put a temporary hold on the full amount chargeable for your Booking, but no funds will be debited from your account at that time) when we receive your Booking.

5.1.7 We will take payment in full once we have confirmed your Booking with the Transport Service Provider.

5.1.8 Payment authorisation is done by an external process and Bucharestairporttransfers.ro is not responsible for using credit/debit cards that are not valid, or for their misuse. In case your online payment was not confirmed, you should address to the issuing bank of your credit/debit card.

5.2 Ride changes

Even after the conclusion of the arrangement agreement and even after the start of the ride, provided it is possible for the TSP, You (and the passenger) can make changes to the Travel Arrangements.

If a ride is spontaneously lengthened (distance or number of hours) according to your wish, or passenger, the actual service (total distance or number of hours) will be newly calculated and priced according to the current price structure. In the case of hourly bookings, each additional 30-minute block is considered for invoicing, i.e. from the first additional minute, a half hour will be rounded up to ensure more reliable planning.

Accordingly, the compensation claim increases for You, due to Bucharestairporttransfers.ro expenses for the Contract of Carriage for the Benefit of You increasing.

If the distance or number of hours are less than originally booked, the price remains unaffected.

5.3 Other premiums

5.3.1 Waiting times for transfer services

For transfer services, no surcharges are applied in the case of airport or train station (excluding long-distance train stations) for a waiting time of up to 45 minutes after the agreed pickup time, at which flight and train delays or earlier flights and trains lead to a deferral of the scheduled pickup time by the planned period of time between the planned arrival time and the original pickup time, and up to 15 minutes from the agreed pickup time in all other cases. Each additional minute of waiting time will be calculated as a flat-rate, including VAT, according to the hourly booking prices of the particular municipal area as well as the vehicle category.

In respect of flight delays, diversions, missed connections when the transport service originates from the airport, the waiting policy is:
5.3.1.1 Flight Delays:
– Private hire with driver: Flight delays from original scheduled flight time of up to 2 hours are included. With Flight delays over 2 hours you must contact the Transport Service Provider to request the vehicle be kept waiting. An additional fee is payable in advance of the transport service. If you do not do this, the service will not be provided.
– Shuttle or Shared ride: You will be offered transport on the next available shared service, if possible.
5.3.1.2 Flight Diversions:
The airline will transport you to the scheduled airport, and the delay policy above applies.
For Flight Cancellations, missed flights and missed connections, please refer to our cancellation policy.

5.3.2 Additional kilometers for hourly bookings

Hourly bookings contain the kilometers (per hour) that are stated on the booking form (or by phone). Any additional kilometers are subject to surcharge, including VAT, and are calculated according to the price per kilometer of the particular municipal area as well as the vehicle category.

5.4 Terms of payment and transaction fees

You can pay for the ride cash or online. Incidental credit card charges are carried by TSP. Any transaction fees when making payments via bank transfer (e.g. due to different currencies or different local accounts) are carried by You.

If you choose to purchase online using credit/debit card, full payment will be deducted from your credit card at purchase time. If not paid for, at the end of this period of time the reservation will be automatically cancelled by the bookings engine.

For credit cards issued in other currencies than the RON, cardholders will incur fees charged by the issuing banks and any difference resulting from the performed exchange, also from the issuing bank, Bucharestairporttransfers.ro having no knowledge or control about the exchange rates used by the issuing banks.

5.5 Payment reminders, unpaid credit card invoices

For each payment reminder, Bucharestairporttransfers.ro may charge an appropriate penalty fine.

For unpaid credit card debts, Bucharestairporttransfers.ro charges You for the incurred expenses (bank, credit card company) and reserves the right to assert an appropriate handling fee per incident.

5.6 Sending of invoices, payment dates

Bucharestairporttransfers.ro provides You with the respective invoice electronically as an attachement to the e-mail confirmation. When paying by credit card or online, payment is due immediately. When paying by bank transfer, the payment date referred to in the invoice must be kept.

5.7 Vouchers

Vouchers are only redeemable individually and cannot be combined with other vouchers. Vouchers are not redeemable for cash.

6. Pick Up and Drop Off

6.1 You must ensure that, at the Pickup Time and at all times during the waiting times referred to in clauses 6.3 and 6.4, one of the Passengers has with them a telephone (or other similar means of communication) that is switched on and is contactable using the contact number provided during the booking process.

6.2 If the Pickup Location may not be easy to locate or apparent from the road, You must provide accurate details to assist the Driver locating the Passengers at the Pickup Location. The additional information should be typed in the ‘Comments for the Driver’ box in the Website, and should include, without limitation, information about unmarked roads, security gate arrangements or specific access and exit gates. Our Transport Service Provider will make all reasonable efforts to arrive at the pick-up point at the time specified on your booking, but this is not guaranteed.

6.3 The Vehicle and Driver will wait for the Passengers, free of charge, for up to 45 minutes where the Pickup Location is at an airport.

6.4 The Vehicle and Driver will wait for the Passengers for up to 15 minutes where the Pickup Location is at any location other than an airport.

6.5 If the Passengers are unable to meet the Vehicle and Driver at the Pickup Time it is essential that You contact the Transport Service Provider as soon as possible to request to rearrange the Pickup Time. You acknowledge and accept that the Transport Service Provider reserves the right to decline any unreasonable amendments to the Pickup Time and/or the Journey.

6.6 If the Transport Service Provider is not informed of any desired change in arrangements by the Passengers, it is likely that the Vehicle and Driver will not be at the Pickup Location when the Passengers arrive (and in any event the Transport Service Provider is not obliged to agree to any such change).

6.7 Neither we nor the Transport Service Provider are responsible for failed Journeys if the details You have provided in the Booking are incorrect.

6.8 As the Transport Service Provider will have allocated a Vehicle and a Driver to a Booking, and the Driver will have incurred time travelling to and waiting at the Pickup Location, and travelling back from the Pickup Location, You acknowledge and accept that in the event of a failed Journey due to:

6.8.1 incorrect Pickup Location and/or Journey details being provided to us in the booking process;

6.8.2 the Passengers failing to be at the Pickup Location at the Pickup Time or before the end of the waiting times referred to in clauses 6.3 or 6.4;

6.8.3 the Passengers failing to rearrange a Pickup Time in accordance with these Terms;

6.8.4 the Passengers requesting unreasonable amendments to the Pickup Time or the Journey; or

6.8.5 any other cause by You or the Passengers

You will not be entitled to any refund in relation to the Booking and neither we nor the Transport Service Provider shall have any liability whatsoever to You or any Passenger in respect of the failed Journey or the Booking.

6.9 The Transport Service Provider retains absolute discretion to choose the route to your destination (drop off location), and it may not necessarily be the most direct route or use toll roads.

6.10 In the event that access via the conventional route is closed due to weather conditions or the like, and you wish to be transported to your point of destination via a longer route, you shall be liable for any additional costs which are payable.

7. Luggage

7.1 All baggage must be properly labeled with the name of the owner and destination address.

7.2 Each passenger may carry one piece of baggage with a maximum weight of 20 kg (maximum combined size of 158cm) and hand luggage with a maximum weight of 5 kg (maximum dimensions of 45cm x 35cm x 20cm).

7.3 Any excess baggage must be declared when you make a service booking request. You shall be liable for all additional expenses incurred, including the cost of obtaining additional vehicles to transport non-declared excess baggage and the supplier reserves the right to refuse to carry the items of excess baggage.

7.4 Your baggage must not contain prohibited articles including: hazardous materials; animals that have not been identified to us in compliance with clause 8 below; firearms; perishable objects or fragile items.

7.5 We recommend that you do not transport fragile or valuable objects such as jewellery, money, precious metals, items of silverware, cheques or other negotiable securities, documents, passports and other ID documents, samples, etc in your baggage.

7.6 Your baggage is your responsibility and is carried at your own risk. Neither we nor your TSP are responsible for loss or damages to the baggage. We recommend that you take out adequate travel insurance to cover loss or damage.

7.7 Baggage left on board the vehicle shall be sent to the address given to us by you in the service booking request and you shall pay any additional charges.

7.8 You must notify us on your service booking request if pets are to be transported. Pets are carried at your risk. Pets must travel in a container that satisfies IATA specifications for transportation by plane. Pets can become very nervous during travel and you must take all necessary precautions. You will indemnify us for any claims, costs or demands made of us as a result of your pet.

8. Special Requests

8.1 If any Passengers have any special requests relating to the Booking or require additional equipment, this should be notified to the Customer Support Team at the time of Booking or no later than 2 working days before the Pick Up Time. Please Note that any special requests or additional equipment cannot be guaranteed.

8.2 Any additional charges incurred as a result of any special requests or requirements for additional equipment will be notified to you by the Customer Support Team and will be payable to the Transport Service Provider at the end of the Journey.

9. Amendments

9.1 If the Passengers need to make changes:

9.1.1 If any Passenger wishes to change the Pick Up Location or Drop Off Location, date, time or vehicle

category, You must cancel and make another Booking.

9.1.2 Any change to Passenger details and/or adding comments for your Driver in the comments box these

amendments are free of charge up to 12 (twelve) and 24 (twenty four) hours prior to the Pick Up Time.

Changes to bookings are generally treated as new bookings. The policy for dealing with cancellations (see

Paragraph 9.1 above) therefore apply to the ride originally agreed upon. A compensation claim by

Bucharestairporttransfers.ro for the originally agreed ride may be made accordingly.

9.2 If We need to make changes: Occasionally it may be necessary for changes to be made to the Booking (after acceptance). In all such cases we will advise You as soon as reasonably possible before the Pickup Time and, if the proposed changes are unacceptable, You may cancel the Booking without incurring any cancellation fee although You shall not be entitled to cancel the Booking if the only change relates to the identity of the Transport Service Provider (which we are entitled to do at any time prior to the Pickup Time). In any case we shall have no liability in respect of any direct or indirect losses You may suffer as a result of such changes or cancellation.

10. Complaints

If any Passenger is not satisfied with the Booking or the Journey in any way or You wish to make a complaint, You should report this to the Bucharestairporttransfers.ro Customer Support Team as soon as possible.

11. Limitation of Liability

11.1 If we fail to comply with our obligations under the Terms, we may be responsible for loss or damage You suffer that is a foreseeable result of our failure or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable only if it is an obvious consequence of our failure or if it was contemplated by You and us at the time the Booking.

Bucharestairporttransfers.ro is not responsible for the misconduct or Negligence of You or any other passenger.

You are the only one responsible for your own luggage and objects (telephones, laptops, tablets etc) if you have forgot or lost them in the car or outside of the car booked for transportation service. Don’t let your belongings unattended or in visible places for the strangers.

11.2 Subject to clause 10.4, neither we nor the Transport Service Provider shall be liable to You or any Passenger, whether in contract, tort (including negligence), breach of statutory duty or otherwise for any indirect losses of whatever nature, whether or not they arise out of any other loss or damage suffered by You or any Passenger. Furthermore, neither we nor the Transport Service Provider shall be liable for any loss of profits, loss of opportunity, loss of goodwill or consequential losses, damages or costs.

11.3 Subject to clause 10.4, the aggregate limit of our liability and the Transport Service Provider’s liability to You and any Passengers, however arising under the Terms or in respect of a Booking or Journey shall in no circumstances exceed the cost of the Booking.

11.4 Nothing in the Terms exclude or limit liability for (i) death or personal injury caused by the negligence of the liable party, or (ii) fraud or fraudulent misrepresentation, or (iii) or any other liability which cannot be limited or excluded by applicable law. Any claim for compensation for death or personal injury resulting from the use of the service must be made to the Transport Service Provider of the service and shall be subject to the laws and to the jurisdiction of the country in which the service was provided. The name and contact details of your Transport Service Provider are provided on your confirmation booking. All vehicles are insured in compliance with local law.

11.5 Except as expressly stated in these Terms, no representation, warranties or undertakings are given in relation to the Services. Any representation, condition or warranty which might be implied or incorporated into these Terms by statute, common law or otherwise is excluded to the fullest extent permitted by law. In particular, no responsibility is accepted for ensuring that the Services are suitable for your purposes (which remains solely your responsibility).

11.6 Please note most Transport Service Providers will not be liable for paying any compensation for any delays, cancellations or missed services due to unforseeable circumstances or events beyond their control, including, without limitation, accidents suffered by third parties on the transportation route, police checkpoints, acts of terrorism or vandalism, extreme weather conditions or strikes.

12. Events Outside of Our Control

12.1 A ‘Force Majeure Event’ means any event which is unforeseen or otherwise beyond the reasonable control of the party in question including but not limited to strikes, lock-outs or other industrial disputes, failure of a utility service or a transport network, act of God, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, fire, flood, storm, unavoidable technical problems with transport, closure or congestion of airports or ferry ports or other locations, cancellation or diversion of scheduled flights, or other journeys, or financial failure of airlines or other transport providers or any act or omission of any party (other than the party in question).

12.2 Neither we nor the Transport Service Provider shall have any liability for or in respect of any failure to perform or any delay in performing any of our respective obligations under or pursuant to a Booking, a Journey or these Terms, if and in so far as performance is delayed, hindered or prevented by a Force Majeure Event.

12.3 In the event that a Force Majeure Event persists within 2 (two) working days of the Pickup Time we may terminate and withdraw the Booking by giving You not less than 24 (twenty four) hours’ notice, and refunding all amounts paid by You to us in respect of the Booking prior to the Force Majeure Event.

12.4 In the case of Vehicle breakdown or mechanical difficulties it is the responsibility of the Transport Service Provider to make all necessary arrangements to ensure that the Journey can be completed as soon as reasonably possible, providing it is safe and feasible to do so.

13. Cancellation

13.1 You may cancel a Booking in accordance with clause 13.2 free of charge until such time prior to the Pickup Time as is specified by us in the booking process on the Website (which will be a time between 12(twelve) and 24 (twenty four) hours prior to the Pickup Time, depending upon the identity of the applicable Transport Service Provider). If there is 24 hours or less before the agreed pickup time, the total price must be paid.

13.2 You may cancel a Booking by either (i) phone at +40720841841 the Bucharestairporttransfers.ro Customer Support Team and confirming the cancellation verbally in that telephone call or (ii) online by e-mail at contact@bucharestairporttransfers.ro, sending us an email with your cancelation request as a reply to our booking confirmation. The money will be charged back to the used credit card, according to the fare conditions you have booked.

13.3 If a Booking is cancelled by You later than the applicable time referred to in clause 13.1 the Booking will be charged in full regardless of whether the Journey has been made.

13.4 We have the right to cancel the Booking upon limited or immediate notice in any circumstances, including but not limited to the insolvency of a Transport Service Provider. In circumstances where we cancel due to issues related to the Transport Service Provider and/or the applicable vehicle which was due to be used for the Journey we will use our reasonable endeavours to arrange for the supply of an alternative vehicle, but at periods of high demand it may not be possible. Where we notify You of cancellation of the Booking 24 hours or less before Pickup Time, You will receive a return of all monies already paid by You in respect of the Booking.

13.5 Exceptional situations such as air-traffic controller strikes, extreme weather conditions, etc. can be compensated only to a limited extent, meaning that longer waiting periods or last-minute cancellations must be accepted by You.

13.6. No-shows without cancellation, delay to You

13.6.1 In case of a no-show without cancellation, You lose your entitlement to carriage over the Transport Service Provider, however this does not affect the compensation claim of Bucharestairporttransfers.ro towards You.

13.6.2 A ride is considered a no-show if You, or passenger, has not shown up without cancellation within 45 minutes after the agreed pickup time at the agreed pickup location. If a customer does not show up, the ride must be paid for in full, whereas possible surcharges for waiting time do not apply.

13.6.3 For airport or train station (only long-distance train stations) pickups the ride is considered a no-show when You, or passenger, has not shown up without cancellation within 45 minutes after the agreed pickup time at the agreed pickup location, at which flight and train delays or earlier flights and trains lead to a deferral of the scheduled pickup time by the planned period of time between the planned arrival time and the original pickup time. If a customer does not show up, the ride must be paid for in full, whereas possible surcharges for waiting time do not apply.

13.6.4 From this rule situations are excluded in which the TSP and the passenger have agreed on a later pickup time by phone. Possible surcharges for waiting time have to be remunerated. Generally, the passenger is not entitled to change the pickup time.

13.7. Cancelation by Us

13.7.1. In extraordinary cases, and if our supplier is forced to make a significant change in the conditions of service, or to cancel the service, we will make the necessary efforts to find viable alternatives to any confirmed reservation that we must cancel. If we are finally forced to cancel your reservation, you will be refunded the full amount of the reservation and this refund will cover all obligations towards the customer arising from such cancellation.

14. Refund Policy
